Buying property in Hungary: the main stages

Buying property in Hungary follows a fairly formal sequence. What follows is the general order of events. The exact paperwork and the requirements placed on a foreign buyer depend on their status and on the terms of the purchase, which is why legal representation here is part of the process rather than an optional extra.
1. Choosing the apartment and agreeing outline terms
You settle on a layout and a specific apartment, receive a full breakdown of what it will cost you and the outline terms: the price per sqm, the deposit, the payment schedule, the handover date. This is the point to ask for a draft contract — it is better read without hurrying.
2. Legal due diligence
A Hungarian purchase is handled by a lawyer. The checks cover title to the land and the buildings, the absence of encumbrances, the seller's authority to sell, and whether the property matches the description given.
It matters that the buyer has their own lawyer and not only the seller's. This is standard practice and implies no distrust.
3. The contract and fixing the price
The contract sets out what is being sold, the floor area, the price, the payment schedule, the handover date and what each side owes the other if that date is missed. Three points deserve attention:
- What actually fixes the price. The date of signature, the date of the first payment, or something else.
- Penalties for missed deadlines. Both those on the seller and those on the buyer.
- How a change in floor area is handled. What happens if the measured area differs from the area on the plan.
4. Payments
The deposit is paid on the contract, the balance according to the agreed schedule. Payments go through a bank, and an international transfer requires documentary evidence of where the money came from — a question best settled before signature rather than after.
5. Registration of ownership
Ownership is recorded in the Hungarian state land registry. The property receives a registry number, the owner receives confirmation of registration, and a completed building receives its technical certificate.
It is the entry in the land registry, not the contract on its own, that makes you the owner.
6. After completion
The practical matters remain: transferring the utility accounts into your name, arranging estate services, ownership taxes, and — if you let the apartment — an agreement with a management company and the tax filings that come with it.
Can the purchase be handled remotely
As a rule, yes: documents are agreed at a distance and signature is possible by power of attorney with a lawyer acting for you. The exact procedure depends on your country of residence and is confirmed before signature.
How long it takes
The timetable depends on how ready the documents are, on banking procedures and on how busy the state offices are. Planning to complete in a week is unrealistic. It is wiser to allow some margin and gather in advance the documents the bank and the lawyer will ask for.
